Welcome to Helyx AI ("we," "our," or "us"). By accessing or using our website, APIs, services, and infrastructure (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

1. Account Registration and API Keys

To access our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are solely responsible for:

• Maintaining the confidentiality of your account credentials and API keys.
• All activities and API requests that occur under your account, whether authorized or unauthorized.
• Immediately notifying us of any unauthorized use of your API keys or security breaches.

2. Acceptable Use Policy

Helyx AI provides powerful text, image, and video generation models. You agree NOT to use the Services to:

• Generate, promote, or distribute illegal content, including child sexual abuse material (CSAM), non-consensual intimate imagery, or terrorism-related material.
• Generate malicious code, malware, or engage in automated cyberattacks.
• Deceive others, including generating deepfakes for fraud, impersonation, or political misinformation.
• Attempt to reverse-engineer, scrape, or extract the weights, architectures, or underlying mechanisms of our AI models.
• Bypass, share, or resell your API keys or account access without explicit written permission from Helyx AI.

3. Pricing, Billing, and Credits

Access to Helyx AI models is provided via a generous Free Tier and a Pay-As-You-Go credit balance system. By purchasing credits, you agree to the following:

• Smart Quota Usage: We automatically prioritize your free daily allowance (e.g., 2,000,000+ tokens). Your purchased credits are only deducted if you exceed this free limit or access restricted premium models.
• Strictly Non-Refundable: Due to the immediate costs of compute resources, all credit purchases are final and strictly non-refundable under any circumstances.
• No Expiration: Purchased credits do not expire and will safely remain in your account indefinitely.
• Token and Media Pricing: Costs are calculated based on input/output tokens (for text) or per-generation limits (for media). Pricing is displayed on our Pricing page and is subject to change with notice.

4. Data Privacy and Training

We respect your privacy. By default, API payloads (prompts, images, video inputs) sent to Helyx AI are processed to return your requested output and are temporarily logged for debugging, abuse monitoring, and billing purposes.

Unless explicitly stated otherwise in a custom enterprise agreement, we do not use your private API data to train our foundational models. For complete details, please refer to our Privacy Policy.

5. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. Due to the probabilistic nature of Artificial Intelligence, we do not guarantee that the generated outputs will be perfectly accurate, reliable, or suitable for your specific use case. You are responsible for reviewing and verifying AI-generated content before utilizing it in production environments.

6. Limitation of Liability

To the maximum extent permitted by law, Helyx AI and its affiliates, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of, or inability to use the Services, or any AI-generated output. In no event shall our total aggregate liability exceed the amount you paid us for the Services in the past twelve (12) months.

7. Termination

We reserve the right to suspend or terminate your account and API access at our sole discretion, without notice or liability, for any reason, including if you breach these Terms of Service or engage in abusive API practices. Upon termination, your right to use the Services will immediately cease, and any remaining credit balances will be forfeited.

8. Changes to Terms

We may modify these Terms of Service at any time. If we make material changes, we will provide notice through our dashboard or via email. Your continued use of the Services following the posting of updated terms constitutes your acceptance of the changes.
